Welcome to Clairva Technologies Pte. Ltd. (“Clairva”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, creator portal, APIs, services, and platform features (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Terms of Service

1. Eligibility

You must be at least 18 years old to use Clairva’s Services. By accessing our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

• Violate any applicable laws or regulations

• Infringe on any intellectual property or privacy rights

• Upload or distribute harmful, unlawful, or offensive content

• Attempt to interfere with the functionality or security of the Services

We reserve the right to suspend or terminate your access for violations of these Terms.

3. User Content and Licensing
When you upload video or multimedia content to Clairva:

• You retain ownership of your content

• You grant Clairva a limited, revocable license to process, annotate, and structure your content for the purposes disclosed (e.g., dataset training, model enrichment, or API usage)

• You can opt out of monetization or data inclusion via the creator dashboard unless otherwise agreed

You are responsible for ensuring you have the rights and permissions to upload and license such content.

4. Intellectual Property
All materials provided by Clairva (excluding user content), including text, design, code, graphics, and datasets, are owned or licensed by Clairva and are protected by copyright, trademark, and other intellectual property laws.
You may not use Clairva’s content or branding without our prior written consent.

5. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy and Ethics Statement. By using our platform, you consent to the collection and use of your data in accordance with these policies.

6. Disclaimers
Clairva provides the Services “as is” and “as available.” We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

7. Limitation of Liability
Clairva shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

In no event shall Clairva’s total liability exceed the amount paid by you (if any) in the 6 months preceding the claim.

8. Modifications to Services or Terms
We may update these Terms at any time. We will post the updated Terms on this page and update the "Last Updated" date. Continued use of the Services constitutes your acceptance of the revised Terms.

9. Termination
We may suspend or terminate your access to the Services at our discretion if you violate these Terms or misuse the platform.
You may also discontinue use at any time. Upon termination, your rights to use the Services cease immediately.

10. Governing Law
These Terms are governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore.
